of the Commission of Appeals, delivered the opinion for the court.

The defendant in error, Glenn W. Musser, who will be referred to herein as plaintiff, brought this action in the District Court of Tarrant County against George H. Sheppard, in his capacity as Comptroller of Public Accounts of the State of Texas, and certain of his deputies, and against the District Attorney of Tarrant County.
