On the trial of this cause in equity the jury found, as a matter of fact, that the respondent, William W. Bradstreet, verbally promised his brother, Peter G. Bradstreet, during the last sickness of the latter, and but a few days before *596his death, that, if Peter should die intestate, leaving him, William, as his sole heir and next of kin to succeed to all of Peter’s estate, he would pay, out of the estate soto be inherited by him, to William S. Grant, the complainant, one thousand dollars annually during the complainant’s natural lifetime.
