The United States of America appeals, pursuant to 18 U.S.C. § 3731, from an order of the United States District Court for the Southern District of New York, Leisure, J., 646 F.Supp. 1568 (1986), dismissing with prejudice, on speedy trial grounds, one count of a superseding indictment charging appellee Martin Roman with managing a continuing criminal enterprise (“CCE”) to distribute heroin in violation of 21 U.S.C. § 848.
