On the 5th day of August, A. D. 1915, ap-pellee, Mrs. A. E. Sherley, as plaintiff, filed her original petition in the district court of Collin county, Tex., against appellant, B. L. Sherley, for a divorce from the bonds of matrimony, the partition of their community property, attorney’s fees, and for the care and custody of their minor children.
