*348This action was commenced by plaintiff, a quadriplegic, to recover damages for personal injuries sustained as the result of Zerega’s towing of plaintiff’s customized van from a handicapped space at the parking lot of a shopping center owned and operated by Bruckner. When plaintiff called the police to inform them that his vehicle had been towed, he was instructed to wait at the shopping center.
