It appears that the appellant was appointed a committee of a person who had been declared incompetent in September, 1881, by a judge of the Court of Common Pleas for the city and county of "Mew York, duly qualified as such ■ committee, and has been acting as such since that time. One of the sureties upon the committee’s bond desiring to be released therefrom, the committee applied to the Court of Common Pleas for a judicial accounting, and a referee was ¡appointed to take and state his accounts.
