MEMORANDUM OPINION AND JUDGMENT

This is an action for recovery of unpaid rents and for restitution of premises. The premises in issue is Unit #1 located in the Island Inn, a licensed “hotel, guesthouse and restaurant,” rented to defendant on a month to month basis.

When the matter first came on for trial on July 15, 1977, this Court dismissed the action on defendant’s motion pursuant to Rule 41(b) F.R.C.P., on the grounds that the subject rental was governed by the Rent Control Law of the Virgin Islands, 28 V.I.C. § 831, et seq., and that plaintiff had failed to comply with the procedural…
