The State of Alabama Highway Department ("the Department") filed a declaratory judgment action against Headrick Outdoor Advertising, Inc. ("Headrick"), seeking, among other things, a judgment declaring that two outdoor advertising signs owned by Headrick had been erected, and were being maintained, in an area zoned for agricultural use and in violation of the State Highway Beautification Act — Outdoor Advertising ("the State Act"), Ala.
