Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of respondent Commissioner of Agriculture and Markets which denied petitioner’s application for an extension of its milk dealers’ license to Dutchess, Ulster and Greene Counties. Petitioner Dellwood Foods, Inc., was the holder of a current and valid milk dealers’ license pursuant to which it was permitted to distribute milk in 14 counties in New York State when, on June 14,1979, it filed with the Division of Dairy Industry…
