I. BACKGROUND
By Order dated March 14, 2007, Magistrate Judge Debra Freeman, to whom this matter had been referred for pretrial supervision, issued a Report and Recommendation (the “Report”), a copy of which is attached and incorporated herein, recommending that the Court deny the motion of plaintiff Daniel J. O’Callaghan (“O’Callaghan”) for entry of default judgment against defendants Adam Sifre (“Sifre”) and James Iniguez (“Iniguez”) and as well as the cross-motion of Sifre and Iniguez for sanctions.
