This is an appeal from a judgment of dismissal wherein the superior court granted a motion for voluntary nonsuit of the divorce action of the plaintiff, Ernest Goin, and denied the defendant, Randi J. Goin, permission to file a counterclaim. The facts, which are undisputed, are these: The parties were married in Canada and have since then resided in Island County, Washington. Randi, a Canadian citizen, entered this country upon a visa, the application for which was accompanied by an affidavit of Ernest stating that he would support his wife while she was in the United States.
