The question presented by the present appeal'is, whether the appellee, Henry S. Mitchell, a devisee and legatee under the will of Robert D. Sewall, Esq., late of Prince Q-eorge’s County, deceased, should be enjoined from prosecuting as an heir at law of said Sewall, his bill in equity for the partition of certain lauds devised by William P.
