THIS MATTER came before the Court upon Defendant’s Motion for Summary Judgment.1 [DE 7]. Defendant contends that Plaintiffs wrongful death claim is governed by the Death on the High Seas Act (“DOHSA”) and, as such, Plaintiff is not entitled to the non-pecuniary damages that she seeks.
