Herbert Ward McCormick, hereinafter called the plaintiff, instituted this action by notice of motion to recover damages for personal injuries alleged to have been sustained by reason of the negligence of the Tidewater Stevedoring Corporation, hereinafter referred to as Tidewater or defendant.

Tidewater filed a special plea alleging that, at the time of the injury, the plaintiff was an employee of the defendant, as that term is defined in “The Virginia Workmen’s Compensation Act,” as amended by an Act of the General Assembly 1944, (Acts 1944, chapter 77, page 97), 1948 Supplement to Virginia…
