delivered the opinion of the court: Edward Hopkinson, individually and as trustee under the will of Eliza Hopkinson, and Edward Hopkinson and the Fidelity Trust Company of Philadelphia, substituted trustees by appointment of the court, under the will of William Swaim, Jr., filed a bill in the circuit court of Sangamon county praying for the partition of 1000 acres of land situated in Sangamon, Macon and Christian counties and for a construction of the wills of James Swaim and William Swaim, Jr. The land formerly belonged to William Swaim, who devised it by his will, which was…
