MEMORANDUM OPINION AND ORDER

A jury returned a verdict in this matter on September 19, 2008, in Plaintiff Fastenal’s favor. See R. 158. Defendants subsequently filed post-trial motions, which are now pending before the Court. The Defendants are divided into two groups: (1) Stewart Ashton, Jr. and New River Energy Resources, LLC (the “New River Defendants”), and (2) Greg Crawford, Todd Robinson, Eric Miller, and Tri-State Industrial Supply, Inc.(the “Tri-State Defendants”).
