Froceeding pursuant to CFLR article 78 (transferred to this Court by order of the Supreme Court, entered in Franklin County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

As a result of a physical altercation among three inmates (petitioner, inmate Hamm and inmate Thomas), petitioner was *1322charged in two misbehavior reports.
