OPINION AND ORDER

The Kentucky Bar Association (KBA) requests that this Court find whether the respondent is guilty of violating SCR 3.130-1.16(d) for failing to take steps to protect a client upon termination of representation. The Board of Governors of the KBA was unable to reach the required number of votes to make a finding of guilt on this charge and, thus, has not recommended a sanction. If this Court finds the respondent guilty of this charge, the KBA then requests that this Court determine the appropriate sanction and order him to pay the costs of this proceeding.
