AYRES, Judge.

This is an action upon a fidelity bond in which plaintiff, Morley A. Hudson, seeks to recover of the defendant, Maryland Casualty Company, the sum of $10,-000.00 with legal interest thereon from judicial demand until paid, together with 12% of principal and interest as penalties and a reasonable attorney’s fee suggested at the sum of $2,500.00. The penalties and attorney’s fee are sought on a basis of defendant’s arbitrary and capricious refusal, without probable cause, to pay plaintiff’s claim.
