This action was brought against John Barton Payne, as Director General of Railroads of the United States, to recover damages alleged to have been caused by lack of proper care and feeding and by improper .handling of certain shipments of live stock made by plaintiffs over the Chicago, Milwaukee & Saint Paul Railroad during the time the railroads of the country were in the control of the United States government.
