Plaintiff sued to recover damages for personal injuries arising from an unprovoked assault, as alleged, inflicted by one of defendant’s employees in its place of business at Omaha while he was there making purchases. Defendant demurred on the ground that the petition did not state facts sufficient to constitute a cause of actio'n. The demurrer was sustained, the suit was dismissed, and plaintiff appealed.
