Defendant moves upon the complaint, answer and report of the Special Master herein under Rules 56 and 12, Fed.Rules Civ.Proc., 28 U.S.C.A., for a judgment and order dismissing the complaint upon the ground that the complaint fails to state a claim against the defendant upon which relief can be granted.
