Appeal from the District Court of the United States for the Southern District of West Virginia, at Charleston, in Bankruptcy; Benjamin F. Keller, Judge. Involuntary proceeding by the Graham Manufacturing Company and others, as petitioners, against the Davy-Pocahontas Coal Company. From a judgment granting the alleged bankrupt’s motion to dismiss the petition, petitioners appeal.

PRITCHARD, Circuit Judge.

The appellee, the Davy-Pocahontas Coal Company, against whom the petition in bankruptcy was filed in this case, is a corporation incorporated under the laws of the state of West Virginia, for the purpose of acquiring, owning, and holding coal and other mineral lands, developing, mining, and producing therefrom coal and other minerals, and making sale of its coal and minerals so produced. The capital stock of this corporation is $500,000. The real property of the Davy-Pocahontas Coal Company consists largely, if not entirely, of a tract of land aggregating 4,040 acres,…
