Plaintiff Dimitre Assenov has sued the University of Utah (the “University”) under Title VI of the Civil Rights Act of 1964, 42 U.S.C. § 2000d et seq., alleging that he was dismissed from a doctoral program as the result of discrimination based on his race, ethnicity, and national origin. He also sued Dr. Melinda P. Kra-henbuhl and Dr. David Slaughter under 42 U.S.C. §§ 1981, 1983 and 1985 in their individual and official capacities, for denying him equal protection, depriving him of property without due process, and conspiring to violate…
