Plaintiff in error was convicted in the criminal court of Cook county of the larceny of a draft for §50 from Herman Klepstein, and was sentenced to imprisonment in the penitentiary. Defendant was a doctor, occupying an office in the Lakeside Building, in Chicago. Herman Klepstein resided near Groton, South Dakota. He came to Chicago December 29, 1897, with a car-load of stock, arriving at the Union Stock Yards at four o’clock in the morning.
