This is an action by plaintiff to compel the specific performance of a contract for the conveyance of real estate. The material parts of the contract are as follows:

“The sum agreed upon for the possession, use, occupancy, and control of said land is $73.60 yearly, which is represented and included in the notes executed by said second party, described herein, and also the whole amount of taxes that are or may be assessed against said land. The purchase price of said land is five hundred and sixty dollars, of which payment has been made of one hundred dollars at the execution of this contract.…
