PLEADINGS
On November 10, 1960, plaintiff commenced an action against defendant, Trailway Van Lines, Inc. (Van Lines), by filing a complaint containing two claims. The first claim charges a trade mark infringement and the second claim charges unfair competition.
The answer 1 denied the material allegations in the complaint and pleaded six affirmative defenses. By order dated January 10, 1964, Judge Rayfiel struck the Fifth and Sixth affirmative defenses (opinion dated October 1, 1963, reported in D.C., 222 F.Supp. 143.)
