The above referenced class action, grounded in the Employee Retirement Income Seeurity Act of 1974, as amended (“ERISA”), 29 U.S.C. § 1001 et seq., and alleging under section 409(a), 29 U.S.C. § 1109(a), breach of fiduciary duty against fiduciaries of three Enron Corporation ERISA plans,1 is before the Court on objections to final approval of the amended and restated partial class action settlement agreement (Ex.
