David Eoff was involved in a traffic accident with Charles Cabaniss, an insured of Central Mutual Insurance Company (Central Mutual). Cabaniss filed a claim on Eoffis insurance policy, but the insurer denied coverage based on breach of contract by Eoff and because the vehicle Eoff was driving was not listed on his policy. Central Mutual reimbursed Cabaniss for his damages from the accident and sought to recover the payment from Eoff. Eoff agreed to pay Central Mutual $8,069.25 through payments of $75.00 per month.
