OPINION

DAVIS, Commissioner.

This is an appeal from a conviction for possession of alcoholic beverage in a dry area. Punishment was assessed at six months in jail and a fine of $500.

The record reflects that after a plea of guilty before the court, sentence was pronounced on the same day, August 9, 1971. On August 17, 1971, and within ten days of the judgment, appellant filed a motion for new trial. On August 20, 1971, after a hearing, the trial court entered an order overruling the motion for new trial and appellant excepted and gave notice of appeal. The record does not reflect that sentence…
