The following are the facts of the case : In the year 1837, the legislature of Georgia passed an act incorporating “ The Irwinton Bridge Company,” for the purpose of erecting a bridge across the Chatahoochee River, opposite the town of Irwinton, in the State of Alabama, commencing on the land belonging .to the heirs of William Oliver, late of the County of Randolph. It appears from the record in this case, that the complainant, who is the assignee of the Irwinton Bridge Company, made appli'cation to the Court below, for an injunction to restrain the 'defendants from prosecuting an' action of ejectment, for the recovery of the land on which the eastern abutment of the Irwinton Bridge is located. After hearing argument, the Court below refused the application for injunction, which refusal, the complainant assigns for error in this court.
