I concur fully with the majority opinion’s treatment of the Headlee Amendment issue. I write separately, however, because I disagree with the majority’s conclusion that a number of provisions of 1996 PA 374 must be stricken from the act as violative of the constitutional separation of powers. Const 1963, art 3, § 2. In my judgment, any potential separation of powers concerns are not yet ripe for decision.
