This matter is before the Court upon the October 14, 1994, motion for summary judgment filed by plaintiff, the University of Cincinnati Hospital (UC Hospital) and the December 12, 1994, cross-motion for summary judgment filed by the defendant, Donna Sha-lala, Secretary of the U.S. Department of Health and Human Services (the Secretary).
