Error from District Court, Seminole County; Tom D. McKeown, Judge. Action by Lula, Seminole Roll No. 908, and another, by Alexander Crain, their guardian and next friend, against S. D. PoweE. There was a judgment for the latter, and the former bring error.

The land in controversy is that allotted, including the 40 acres designated as a homestead, to Annoehe, an en-roUed citizen of the Seminole Nation. According to the stipulation of the parties, Annoehe was by blood a Caddo, or Wichita, Indian, and did not have any blood of any of the Pive Civilized Tribes of Indians, but was an adopted citizen of the Seminole Nation, and enrolled as such on the approved Rolls of Citizens by blood.
