*736In an action to recover damages for personal injuries, the defendant appeals, as limited by his brief, from so much of an order of the Supreme Court, Kings County (Kramer, J.), dated February 26, 2009, as denied those branches of his motion which were for summary judgment dismissing the plaintiffs claims of serious injury under the permanent loss, permanent consequential limitation of use categories of Insurance Law § 5102 (d), and significant limitation of use on the ground that the plaintiff did not sustain any such serious injuries within the meaning of that statute.
