In addition to what was said by Trimble, J., upon the original submission of the case we make the following observations.

• The case of Adair Drainage District v. Q. O. & K. C. Railroad, 217 S. W. 70, which has been called to our attention by defendants since the opinion by Trimble, J., is not in conflict with anything said in the original opinion. The facts in that case show the case is practically on all fours with the Groll case.
