The defendant, John Kevin Hurley, requests that this court reinstate his appeal and reconsider his case under G. L. c. 278, § 33E. The defendant has been convicted of murder in the first degree. On appeal from the denial of his motion for new trial, we held that the defendant was entitled to a new trial because he was denied the effective assistance of counsel. Commonwealth v. Cobb, 379 Mass. 456, 461-462, vacated sub nom. Massachusetts v. Hurley, 449 U.S. 809 (1980).
