This is an eminent domain case. The State of Texas, acting by and through the City Council of Daingerfield, Morris County, Texas, instituted condemnation proceedings against H. B. Walker and wife, Irma Walker, seeking to condemn land of the Walkers for state highway purposes. The Walkers appealed to the County Court of Morris County, Texas from the award made by the special commissioners. There was a jury trial in the County Court.
