WINDES, Justice.

Plaintiff appellant, Rosa M. White, filed complaint and amended complaint under the provisions of section 27-815, A.C.A. 1939, against her husband, Joseph White, for separate maintenance for herself and two minor children. The defendant appellee filed what he designated “Motion and Answer” wherein he moved to dismiss the complaint upon the ground that the court did not have jurisdiction over the person or subject matter of the action for the reason that he had obtained a decree of divorce against the plaintiff in the state of Colorado and that such judgment was res judicata as…
