The plaintiff in this civil action is the United States of America. The United States has brought suit against Ellis Turk, M.D. (“Dr. Turk”) seeking civil penalties for violation of the record keeping requirements of the Controlled Substances Act, 21 U.S.C. §§ 827(a)(3) and 842(a)(5). Dr. Turk is registered with the United States Drug Enforcement Agency (“DEA”) and is certified to dispense certain controlled substances to his patients.
