—In an action for the return of a down payment pursuant to a contract for the sale of real property, the defendants appeal from (1) a decision of the Supreme Court, *502Nassau County (McCarty, J.), entered September 10, 1998, and (2) an order and judgment (one paper) of the same court, entered September 15, 1998, which, upon granting the plaintiffs motion for summary judgment and denying the defendants’ motion for summary judgment, is in favor of the plaintiff and against the defendants, and directs the escrowee to return to the plaintiff her down payment.
