As the case went to trial this suit was one by the appellee Russell against appellant, the Rule Cotton Oil Company, to recover damages resulting from personal injuries. As alleged and substantially shown by the evidence, appellee, as one of appellant’s workmen, was engaged in unloading cotton seed out of a car that had been spotted on a switch track leading to appellant’s cotton oil plant. The switch track extended in the general direction of north and south.
