STATEMENT OF THE CASE
Lowdermilk, J.
This is an appeal from the trial court’s denial of petitioner-appellant Max McCurdy’s (Max) petition to allow visitation rights.
FACTS
In April 1975 appellee Barbara J. McCurdy (Barbara) filed with the trial court her petition for the dissolution of her marriage to Max. At that time Max was in the county jail awaiting trial for one count of kidnapping and four counts of rape to which he ultimately pleaded guilty.
