Appellee instituted this suit in the district court of Montgomery county, Tex., -against Chas. O. Austin, banking commissioner, and the First State Bank of Dobbin, Tex., alleging that the bank had voluntarily placed its assets and affairs in the hands of the commissioner for liquidation; that she was an unsecured, noninterest-bear-ing depositor with the bank, at the time the commissioner took charge of its affairs, and as such prayed judgment for the amount of her deposit.
