This is an action commenced in the district court of Jefferson county by defendant in error, J. W. McKenney, plaintiff below, against E. C. Ward, plaintiff in error herein. The parties will be referred to as they appeared in the trial court.

Plaintiff alleged in his petition that he was in the real estate business, and that the defendant, the owner of the property described in the petition, listed the said prop'erty with him for sale by written communication and agreed to pay a commission of $300.
