Appeal from a judgment of the County Court of Broome County (Cerio, Jr., J.), rendered November 7, 2008, convicting defendant following a nonjury trial of the crimes of criminal sale of a controlled substance in the third degree and criminal sale of a controlled substance in or near school grounds.
