Taylor, J.:

The plaintiffs in error, as plaintiffs below, on March 8th, 1886, sued the defendant in error in the Circuit Court of Duval county in an action on the case for damages for an alleged breach on the defendant’s part of a contract entered into in writing with the plaintiffs, whereby the defendant agreed to purchase from them at an agreed price and on a certain date a piece of real estate described as lot 2, in block 5, in the city of Jacksonville.
