This action was begun before a justice of the peace of Jackson county, against the contractor and the owner of a one-story brick building, *106to recover a judgment for $265, and to enforce a mechanic’s lien against the building for that amount. Judgment was rendered against the contractor for the amount claimed and also enforcing the lien against the owner’s property. The contractor, alone, appealed to the circuit court. In the latter court the contractor filed his motion to dismiss the cause of action on the ground that the justice had no jurisdiction. This motion was sustained and thereupon…
