I. INTRODUCTION

CURTIN, District Judge.

Plaintiff Mujahid Farid commenced this action, pro se, while in custody of the New York State Department of Correctional Services (“DOCS”), at the Attica Correctional Facility (“Attica”). Farid brought this action pursuant to 42 U.S.C. § 1988, claiming violations of his First and Fourteenth Amendment rights. On August 4, 1998, the court assigned Mark C. Poloncarz, Esq., to act as attorney for Farid. Item 48. 1
