MEMORANDUM OPINION AND ORDER

GAGLIARDI, Senior District Judge:

This is a motion by Defendant, Atlantic Mutual Insurance Company (hereinafter Atlantic Mutual), for judgment as a matter of law, or in the alternative for a new trial pursuant to Federal Rules of Civil Procedure 50(b) and 59 following a jury verdict of $385,-882.43 in favor of Plaintiff, Stewart Sleep Center, Inc., d/b/a Matter Brothers Furniture (hereinafter Matter Brothers).
